Hi, I have a H1B from company A stamped in my passport and it has been expired in sep 2005. I joined company B in march 2004 and I have their I-797 valis till Jan 2008. I am going to India to stamp it on the passport. Is their any issue with this ? I heard that if one is changing the comany, he/she has to stamp the H1B of the new company on the passport within 6 months or so. Please help.

I've a situation here to switch from Company A (who sponsors my GC and H1B) to Company B, I've completed AOS (6 months period too):
1. Whether I can transfer my H1B (sponsored by company A) to company B when i join them? (but H1B is not stamped yet on PP) if not H1 transferrable, then I've to use EAD only.
2. Company B will ask me what papers I need for GC sponsorship either NOW or in FUTURE, can anybody know this? please help
3. I know that i need to file AC-21 to do the switch, what are the procedures like:
a. job position should be same or similar?
b. what paper work other than AC-21 needed to do this switch in changing employer information, fees for doing this change?
any help/advice would be greatly appreciated. Please let me know.

Have you tried calling their office? From what you say, it been more than a month! Call the TX center and if their answer does not satisfy you, lodge an official complaint with the ombudsman's office.

I am wondering how do I help / sponsor to obtain US tourist visa (B2) for my young (say below 10 years) niece and nephew in India. Their parents (my brother and his wife) will not travel with them so they do not need a visa.

Hello,
I'm available for all aspects of Flash development from Flash video to ActionScript. One of the projects I'm currently working on is a virtual tour, fully updatable and dynamic.
I also understand and have developed AfterEffects peices for web publishing purposes. So if you need Flash animation, I can do that too. My lastest work was a FLV and Flash intro peice for Enyce.

Hi friends,
Company A has filed my 485/EAD/AP. I am planning to change company B on AC21 after 180 days. Can I use AP which is filed by company A, for travel purpose after switching to Company B?

it is possible (answering a question you directed towards Kirupa)
shift click on the objects you would like to group. Click on arrange and group. To undo it.. click on Arrange (ungroup).

My wife is working for US firm on L2 VISA (EAD).
The employer is ready to sponsor her GC. We wanted to know what is the process for L2 candidate , will it be same starting from Labor .... or we can skip labor and make use of current L2 EAD to file I-485 directly ?
Nope...she has to start with Labor and apply for a 140 in either EB3 or EB2 categories. Only L-1A visa holders are eligible to skip labor and apply in the EB1 category.

gcformeornot is correct. You cannot "transfer" an I-140 approval, but you can keep and use the PD for any subsequent I-140. Once a new LC is approved, a copy of the I-140 approval notice with the 10/2007 PD should be included in the new I-140 submission along with a request to use the old PD on the new I-140 approval notice.

systems analyst --- Various unanticipated client sites in Illinois,Texas and elsewhere
Duties - analyze design develop test integrate and implement software applications databases and systems using Oracle and oracle Applications,C.
My new role is Sr Operations System Analyst -- place CA
Role will be assistinginstall design test implement and integrate systems/applications with oracle and Oracle applications.
Can I go ahead with this job? Or this will not fall under AC21.

So this may be the last week of H1B visa filings, as of November 27, 2009, approximately 58,900 H-1B cap-subject petitions had been filed. USCIS has approved sufficient H-1B petitions for aliens with advanced degrees to meet the exemption of 20,000 from the fiscal year 2010 cap. The big question is that why the so called "IV leadership" is not filling a FOIA request for how many EB3-I cases pending till date. Infact they should ask numbers for all the categories and their priority dates. It should be simple SQL query for USCIS.
This is such a burning issue and so many people are suffering from it. I still don't get it why would IV is not raising this issue... Can some one from leadership group respond please.......

My future employer "A" has filed an appeal I290B for denied I140 ("Inability to pay") which is pending at USCIS, however now my current employer "B" wants to file I140 for me. Both of this are on different labor approvals and different job descriptions. Can my current employer "B" file I140 without my future employer "A" withdrawing the I290B appeal? Will filing of I140 by my current employer "B" affect the denial of any of these applications?
