Besides importing new H1s, the best way to increase the number of professionals in a pool of "Talent for hire for the highest bidder" is to free up half a million existing H1bs from their bond with current jobs by speeding up their greencard.

I have applied for AP (I131) on 8/14/09 and my I-485 got approved on 9/01/09. Is USCIS is going to return my I131 fee or is there anything I have to initiate from my end to get the refund?.

Hi
I am working on H1B from Oct 2009. My employer and client has one layer between of them. For some family reason I need to visit India for 10 days. Will it cause any problem / Issue on airport (immigration counter) when I will come back to USA ?
In this case how can I prepare myself to face situation? What documents do I need to prepare to prove that even though I am working with one layer then also my employer control my salary and tax stuffs ?

I was laid off in Dec 2009, but severance will stop till early Feb. Now I found two potential jobs. Company A is a corporation in same state, but company B is a university in some other State.
1. How long will take them to transfer my H1B? does the different States matter on this transfer time? I want to make sure which one can submit the H1B transfer before my paycheck stops in Feb.
2. In order to apply for Green Card later, which job is better for Green Card application? I heard university will not help the staff (accountant) for Green Card application. Is that true?

Hi,
I am in weird situation. I left my previous employer because they didn't file for my concurrent filing during July '07 madrush.
They applied for my I-140 on 26th Sept 2007 thinking that I may change my mind and stay with them.
It seems that they didn't revoke my I-140. Since, yesterday, I got email notification from CRIS about I-140 approval.
Now a question for Gurus:
I am not sure but my previous employer may revoke it anytime. Based on the email notification and the online approval snapshot, can I port my priority date to my current application, with new employer, even if previous employer revoked my approved I-140 ?
Personally, I was happy with my previous employer except for the concurrent filing that they didn't apply. Now, I am in dilemma. should I should rejoin my previous employer or not?

Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. He voted with anti-immigration Senators to filibuster the 2007 version of comprehensive immigration reform and there is little reason to believe his vote in 2010 would be different. the LCA needs to be done for any H1B or when the job is in a new location. it doesn't take long to get that submitted (<1 day) no need to go stamping. it doesn't cost any money to submit a new LCA

I was with ABC consulting company and had applied for GC (and got perm and 140 approved). My contract with client ended. Though ABC were good but they could not get me a project so I had to shift to another company. I talked to ABC to get my GC proceeding with extra cost. They said (and attorney also) said my 485 has been filed. As the ABC had changed their name also, as notification for I-140. They also insisted to join back.
My new company layoff quite a lot of people. Needless to say, me also. Now my easy option is to join them back, but is there any possibility that to make me continue to work for them, they can do mess up in GC process?
May be question is quite personal, please suggest whatever cmes to your mind.

I am taking up a new job... The pay is good (10% more) and position is also of a senior lead developer.. I am not even leaving the area.. The company is 5 times bigger than my current one... I have an EAD card valid till Sept end 2008....What is your opinion. Should I go for the new offer? I am worried if anything will happen to my GC processing. Please help me make a decision.. My employer has been holding back my wages on some excuse or the other. Since I was awaiting my GC, I had no choice but co-operated with them. I got my GC last year in July 2010. I worked with them until September 2010 and due to this payment situation, I have chosen to work elsewhere.Now they promise to pay the back wages from 2010 but the payment never arrives. Repeated followups, emails and calls have yielded the same result. I am not sure what are my options here at this point. I no longer work for that Employer since they never pay on time.

I need a clarification on EAD card usage. If your spouse whio has an independent H1B visa and whose 485 and EAD application is dependent on you, changes the work status from H1B to EAD, then does the status of the primary applicant also change to EAD automatically. Since the spouse's application was not independent filed and was a dependent on the original applicant for both 485 and EAD applications. I want make sure that the primary applicant's status ( separate independent H1B ) is not changed from H1B to EAD, just because of the spouse starting to use the EAD ( who is a dependent filer on primary applicant for both AOS and EAD ). Would appreciate your inputs.

My daughter has joined in a medical program in India and she has to return to US after 4 years to continue her studies. Her 485 is in process and she has stamped H4 upto 2012 ( 3 years from now). I am trying to find out the best strategy to get her here after 4 years if we dont get GC prior to H4 stamping expiry.
Should I continue to apply her EAD and Advance parole whenever she visits US (She will come to US atleast once every year)? Or Can I apply for her EAD and Parole just before the expiry of her h4 stamp (That is after 3 years)? Please advise.
