Hi all,
Mine is Labor Substitution with EB2 India PD is April 2005 and with the same Employer since 5 years .
6 months back my case was moved to New York (I am working in NY as a consultant ) regional center where I am working now.
I have to move to NCarolina this month end for a new assignment. What should I do now?
If I inform USCIS thru AR-11, how much time they take to transfer my case to new regional office? Worried if they take long time and dates retrogress before they transfer.
How early can I apply AR-11 and how late I must inform them?
Anybody with similar experiences? Pleas suggest me the due course of action.

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? Hi, I have a query regarding the opt to h1b process ,the answer means a lot to me.
I am getting my h1b filed through a desi consultancy in the coming april in premium category.I am on opt and it has its validity till jan 2009.I will be giving interviews for a couple of finance firms in may/june in which i will most likely get one.now my point is i know i can change my job to this new company in june/july since i am on opt .I will take my h1b papers with me but come october i will get into h1b status.will it be a problem for me to remain in the new company which i shifted to, do i have to get back to my old company till i get atleast two pay stubs on h1b or is there any way to continue working in my new fin company without any trouble.the pay slips which i would have got during the months before i shifted jobs will they be suffiecient to get my h1b transfered to the new company.
Gurus pls throw some light. it is really very important for me.

I have future GC filed from Company X, the priority date is February 2006.
I am currently working for Company Y on H1B. This H1B will expire in April 2009. Company Y is also ready to file my GC and I would like to work with Company Y till by future GC is approved, my question is
If I have already filed for 485, EAD and AP through Company X, scenario will it be advisable to file another labour and I-140 through Company Y now?
What could be the implications?

Hello,
I run an IT business from here in Canada and make about US$ 80K/Year. I am now thinking to move to USA and was wondering how I could use my company to benefit and help me with that.
Is it better to move the company to US or is it better to open a subsidiary in USA? Also what are the minimum requirements to be successful in the immigration visa? Do I need to declare a minimum amount to the Canadian government etc.., that will be a proof for my company etc..?
I run the company myself with my common-law-partner. We do everything, including sending bills, invoices etc..

Hi,
I have an interview scheduled for my H1B revalidation stamping at the Mumbai consulate next week. My son will be accompanying me for his H4 stamping.
My wife is already in the US(she travelled using her AP).
The FAQ page of the Chennai consulate says that incase both parents are not accompanying the child for the interview, then the absent parent must submit a signed and notarized 'no objection certificate' to the parent going for the interview. There is no such mention on the Mumbai consulate FAQ page.
Question - Does this apply in my case - since my wife is already in the US ?

My wife who is currently working as a doctor in medically underserved area(J1 waiver case), on cap exempt H1B visa. Her clinic is contemplating name change. I will really appreciate if someone can shed the light on how might this proposed name change can/will impact her status?
Her visa is currently unstamped and we are planning to get the same done this year in october. My queries are as follows:
1. Will a new waiver petition and H1B visa need to be filed or only an addendum notification to the USCIS will suffice?
2. If the latter is true then what kind of additional documentation will be needed for visa stamping from the lawyer?
Attorney input will be highly appreciated.
