05/30/2008: Corrected TSC I-140 Processing Times - Not 08/26/2007 But 07/16/2007
* AILA has reported that the TSC corrected the error in its 05/15/2008 processing time report for the I-140 processing times. The date of 08/26/2007 was an error and the correct date should have been 07/16/2007. The official report will be corrected soon :(

Hello All,
Being on H-1 never allowed you to get promoted unless the employer did all the necessary paperwork with USCIS/DOL. EAD being work authorization not limited to current employer, can EAD mean a little more freedom to waiting-for-GC H-1Bs in terms of being able to get promoted within the organization, get different job titles, etc ?
Also, I have 140 approved and H-1B ext was granted for 3 years (till 2010). Does it make any sense to apply for EAD alongwith 485 ? If EAD gives the career advancement opportunities, can I apply for it but keep using my H-1B to re-enter US till 2010 if needed ?

Hi All,
I just called USCIS using the POJ method to check on my I485 status which is current for June (EB2 India PD is 3/20/04).
IO said a visa needs to be ordered for the file and it will be done in the next quarter i.e, July 08.She also said the file will not be assigned to the IO unless the visa is ordered??
Does this mean that all the visas for EB2 have been used for this quarter? Also, not sure why the file wont be worked on until the visa is ordered...which contradicts the pre-adjudication theory.

HI, i filed for my sons GC with an i-130. i received an I-797C saying it had been approved n a priority date of 02/26/2004. we have been waiting for years now i just checked the priority date and its already past that if im reading correctly its now at july 04...i am a US resident. i called the NVC but the automated service told me they are still processing visas from 1999?? What should i do?? can anyone give me decent advice on this? Thank you...

Hi all,
My I-140 was approved 2.5 years back and I-485 was also approved more than an year back.
But, today the status on my I-140 got changed to "REQUEST FOR INITIAL EVIDENCE SENT, CASE PLACED ON HOLD". I am not sure, why did they reopen the case again. I checked with my company and they assured me that they didn't revoke my I-140.
Could anyone suggest me what's happening to my case. Has anyone seen an similar kind of an issue and wat shd I do further ?

My brother is US Citizen and my parents visited US, my brother want to apply green card for my parents. What all the documents from India are needed from my parents to apply for GC?
1.What forms/applications do we have to apply?
2.What is the first step should we have to take?
3.Do we need to apply form I130 and along with that can we apply I485?
4.What all documents should my brother submit along with the forms/applications?

Hi,
My husband and I work for a large MNC. We have our own L1's. Currently my husband's L1A is under processing. There is a RFE on it.
I want to know if we can change the status for him from L1 to L2 or to H1 without he having to leave the country?
If so what is the process to do it?
Can I apply for his L2 while his L1A is under processing?

I have my H1 filed in 2008. Due to the market situation, I didn't go for H1 stamping and entered US in March 2009 on H4.
I would like to know the steps/process for H4 -> H1 COS.
I know my employer is the best person to answer this. But, the problem is whenever I ask any details, he always tries to abstract the info.
If there are sequence of steps, after which step one is authorized to work? I tried getting the info online, but couldn't . If any of you can give me a pointer or explain the process in detail, it would be very great and helpful.
As per my employer, I can start working in 2 weeks after he initiates the process. I want to make sure that I don't run into any legal issues. Once the employer has initiated the COS process, is there a way one can track the status and also to verify the status after the completion of the process.
Sorry for too many questions. But, please please do help!!!

Hi,
I tried to search for this and could not find anything.
When dealing with 485 portability using EAD (with approved I140),
what happens if your underlying LC is a location/region/state bound and you end up moving to out of that specified region.
Job duties/job code can stay similar with probably salary increase.
Does the location violation get equated to unequal/dissimilar job duties resulting in 485 denial?
Chances are that should I have to invoke AC21 portability(due to layoff or something alike), I'll be facing this so I just want to be prepared for possibilities.
