Hi,
I am trying to change my job from PM to technical lead. My labor was filed for computer systems manager. Will technical lead come under the same category & occupation as computer systems manager?. New employer agreed to give me similar job duties in EVL & I am getting 40% hike. Is it wise to use AC-21 here?.

I initially voted in favour of this, but on further reflection, I think this is bad policy and urge others to not support this.
Giving I-485 benefits to people without current PDs is a bad idea. It creates a class of immigrants who are neither non-immigrant visa holders (h1b) nor are they lawful permanent residents (i-551) with a set of rights that falls into neither category. The AoS pending status is intended as a short-duration temporary "gap" coverage for people who are a matter of months from having actual I-551 rights.
Essentially, this proposal aims to make every month into the July 2007 fiasco. In addition, and this is the truly horrible part of it, relieves US employers of the pressure and costs they feel now, extending H1Bs every 3 years. That means that the only allies that legal EB immigrants have (US Employers who require their services) are detached from the immigrants themselves...they no longer have a dog in the hunt, and will stop whatever pressure they are bringing to bear now upon Congresscritters and Senators to increase the number of EB visas available.
Disconnecting the interests of foreign-national employees from their US employers will weaken the political position of the foreign-national employees. We cannot vote or contribute to campaigns, our employers however, can do both. If employees are shifted to EADs and APs, with no further involvement of employers in their immigration status needed, then those employers become disconnected from the process, and the one and only ally the legal immigrant has is no longer interested. That's a horrible thing for the immigrant to advocate.
I strongly urge IV to back away from this proposal, as it is not in the long-term interests of the EB Immigrant community. I urge IV to instead focus their resources on items that will help immigrants long term, like increasing the number of EB visas available through initiatives like eliminating the DV program and allocating the visas to EB applicants.

The wait time between filing I-485 and receiving the green card is already beyond the norm and a lot of companies are aware of this. Imagine the wait times for the people who haven't yet been able to file for their Adjustment of Status. Wouldn't it help them (and their dependents) if they are at least allowed to file for their AOS? I invite the members to provide their perspectives on the issues raised by JeffDG above. Please do not attack each other. Let us fight together in lieu of fighting each other..

could any body please let me know which time is the best time for checking/taking interview appointment from VFS site as from 3 to 4 days onwards i am checking for the availabity dstes in VFS site for scheduling appointment but there is no dates available for our language.
I read somewhere regarding the partiicular time(as soon as after updating the available dates in that site) , at that time if we check the VFS site if any appointments are available for that day it will show else no dates in that full day. thank you for all .

Can I work with different employer without my sponsor company knowing about it? I have a EAD and I can change jobs(180 days is over). Now planning to start a company/to work on W2 with new company. I want to use the medical benefits from sponsor company(withought quitting the job).

USCIS is reporting that as of November 6th, 54,900 H-1Bs had been issued against the 65,000 annual quota. While this represents a dramatic drop in H-1B applications over previous years. In 2007, nearly 200,000 applications were filed in the first week applications were open and in 2009, the application period is now in its seventh month. Usage seems to be about 1,000 cases a week so we're probably looking at January or February to run out of numbers. Incidentally, yesterday I was the moderator of a panel on the impact of the global recession on national migration policies in Amsterdam....

Now the Wall Street Journal picks up the theme. Words are nice. But if you can't control the vitriol coming from the Tea Party wing and actually work with Dems on immigration reform, you're not going to reverse the damage. In short, conservative Hispanics still perceive the GOP as anti-them. And PR campaigns aren't going to fix that problem. But promoting pro-immigration candidates, as some groups mentioned in the article are doing, is a hopeful sign.

she will be on EOD once she quit the Job. You may not have to file COS to H4.
My wife quit the job last year she was on H1. and we didn't get any RFE till date..
