I am curious..
why USCIS/ DOL needs a law to re-capture visa # which were not used in previous years ?
I mean Congress already authorized these ? Canot DOL/ UCIS make a judgement based on their own ?

There is no law to allow re-capture of visa numbers as of yet. In fact it says the opposite in the existing laws - That the visa numbers may not be re-captured.
There has been one case of visa recapture law passed during the Clinton administration and they did not allow a rollover recapture (I believe they recaptured the visa numbers that were lost between 1995 and 2000 only (please correct me if I am wrong about the years))

Not really, The PD will be stuck sometime in 02 or 03. Thus, unless there are some changes in law, we are looking at 5-7 years wait.
Also, I am not fabricating 750,000 number. This is the anticpated applicants, per Matthew Oh.

If the GC quota is 9800 for India then to process 750,00 applications ( most of them will be India I am sure ) will take like 20 years . Thats impossible man !!!

My point - I am going to take things in a stride, basically wait till I can - doesn't hurt me as long as I go about my daily routine.
All who are thinking of jumping the fence and giving up, one piece of advice - if you do not have kids and plan to have any in this life, please do it NOW - have them be born here (all of them) and then move on with whatever / wherever you want to go.
At least this is a gift you will be giving your kids for their lifetime and all the generations following them (remember - a US citizen's kid can be a US citizen no matter where he/she is born) - so you will be arranging US citizenship for all your great^n * grand * kids (0 <= n <= infinity) !
This is how I think about it when I do not think about MYSELF. Once the kids are born, you can flaunt their American Passports and feel happy in their well-being and security (for whatever it is worth) and move on to Canada / India / Singapore / wherever! Live happily.
And do not forget your kids can sponsor you when they are 21.

I live in LA and would love to be a part of the SoCal community.
I'm waiting to apply for the I485. I heard from my attorney second week of June that USCIS has expedited the process and we need to file by end of July. I got my medical done in a rush and then we hear they're not going to accept applications. Any idea how long the medical remains valid?

May be yes....applying greencard is required to extend the H1...having said that one has to spend huge money in applying for GC...at the same time one can also stay out of US for an year and come back if required...
well the reasons are many...and all seems to be valid...
I agree having 1 crore is sort of middle class..especially with the real estate boom in Hyderabad..you won't get a two bedroom flat in a decent area unless you pay around 20 lakhs...
on a lighter note...1 crore is just simple....for the people over there...for example my father retired in early 2004 and spent his retirement money to buy a two bedroom apartment and a small piece of land (about 10 lakhs in total)...now the apartment itself costs about 11 lakhs and land costs about another 14 lakhs.........earning/saving of about 15 lakhs in 3 years....how many of us could do that ;)
when i came to US at first i thought i would go back to india if i have 1 crore, but when time goes by, i came to know that now a days in india people who have 1 Crore are considered as Middle Class,

I have been asked to send ADIT photographs not computer photographs?
Anybody knows what ADIT means???

I had similar issue when trying to refinance
My loan was Jumbo and to bring it to confirmation limits to get better rate the lender
tried doing home equity loan, at the end when we thought every thing was ok
they back and told they cannot give home equity loan because my Green card has not been aproved though I provided the AOS reciept and EAD.
The underwriter is FannieMae.
This for sure is a discrimination, in the current situation we cannot really make any benefit out of low mortgage rates..and the when the ARM is close to expire...god knows how
the interest rates would be.

Did you check the New I140 approval notice? The priority date on the latest I140 will have your Old PD. I believe its also advised you file an interfiling request.
Thanks for your reply. I still have to find out from the lawyer. All I have heard from him is 140 is approved. Before filing 140 he did say alongwith 140 application he will send a interfile request. I checked my 485 application online there is no change in LUD.

I'm looking for homeloan options in India. Which bank would be good to apply for home loans.
Was thinking about ICICI bank but got scared after going through the other thread about how ICICI bank is into stealing.
I would appreciate it if anyone can give me few suggestions on this.

As many members posted, avoid ICICI. When you apply for loan, they will come to you and lick your feet and will do all sorts of promise about services. But after you take loan, you won't find same level of service.
But whatever bank you decide to go with, DO NOT GIVE THEM YOUR SOCIAL SECURITY NUMBER. It is not safe at all in their hand. Some banks requires SSN and some don't. ICICI requires SSN and credit report authorization. Negotiate with them. We negotiated with them and refused to give them social security number. We generated credit report ourselves and crossed out SSN and all account numbers from it properly. We did the same thing with other documents ie paystubs etc.
We have two home loans one with ICICI and another with SBI. We have better experience with SBI. My parents are power of attorney holder and they mostly deal with bank and according to them SBI is much better then ICICI do deal with locally. We have now decided to prepay our loan with ICICI in next 6 months in full.
Again remember DO NOT GIVE THEM YOUR SOCIAL SECURITY NUMBER.

I have been reading all the posts, in my opinion we all came here broadly because of 2 reasons.
a) Want to earn more money
We have considered our parents are of Middle Class family and We wanted to be the UPPER Class parents to our childern.
b) Want to achieve Career Goals.
We have always considered US is the place where you would find the latest of everything ex. Car, Electronics, Life Style etc.. We wanted to enjoy.
When time passed these things have got changed in our home country, But at the same time we could not make a decision because of other factors which would influence our Decision.
In my opinion IF YOU have become a US citizen MENTALLY then you don't think of going back, You have to ask this question to your self. AM i a US Citizen Mentally or Indian Citizen?. If the answer is Yes to US Citizen then having Green card or not having does not matter, you would stick to US and won't think of going back.
The problem lies with people like me Who could not find a answer to the Question So simply because of following reasons.
a) Professional Life
I like to work in US because, i can spend more time with family, i don't have to drive a lot to go to work, i can leave at 6 every day.
b) Personal Life
I am afraid because i dont like the family or personal life style here is US. I COULD NOT accustom myself to this life style and i am afraid What if my Kids started behaving like American youngster at his/her 20s and 30s, i am afraid about my 60s.

Somehow i could not conclude how much i need to go back to INDIA.

I have been a donor since 2006 and donated about $1000+ through 3 or 5 one time payments and monthly subscription of $20.
But I discontinued my monthly subscription seeing absence of IV core for long time in 2008. But more than that I was completely pissed off with free riders with one time questions and then disappearing, nanny questions, people sharing jokes on this forum, people commenting on the internal matters of their own country and so on. I felt the forum was being used for all other matters except the one issue it was formed to address: "RETROGRESSION in EB IMMIGRATION".
I am fully supportive of paid membership and welcome this step. I thank IV admin for the same.
Now my questions are
What is the vision / mission/ purpose behind the "donor forum"?
whether members will still be able to post questions for free and get answers? And of course vanish after that.
Would the anti immigrants still be able to use our forum and make posts to tease us?
And most importantly do I have start monthly subscription again to gain access to this forum? If yes, Can I just restart my $20 monthly subscription?

Agree with you, tinamatthew, regarding H1C visa, but my emploier does not want to waist his time for this, the chanses are too slim to get one of 500 H1C..., so I decided not to mention about it.
Maybe.... , the july victory might help, I just hope they will approve my DS230 this time, because previous DS230 was out of date, and they asked to submit it again.
But it is only one case, other nurses are still in the long process with CGFNS, and VisaScreen, then I140, with the huge backlog in the Visa Center , and so on...I am not against all these procedures, I believe it is a necessity, but the long immigration process for nurses is neither fair nor correct from healthcare and economic point of view.
So I believe for the majority of foreign nurses the July VB is not helpful in anyway.
Schedule A is our only option!

I had started a healthcare thread previously and it got poor response. Eventually we created an iv-physicians chapter to track our issues and work with the core team on the overall goals of ending retrogression.
There are a number of efforts on to help Schedule A applicants, some of these are parts of more comprehensive efforts like Cornyn's recent amendment.
I suggest you organize the Schedule A folks into a group. IV is very happy to work with any group that takes responsibility for their own needs.
