This is turning out to be TRUE.
Past week, I made this comment and some people made fun of it. But, it's turning out to be true. They are now fully focusing on EB3 and I think they will continue to do untill they finish all Eb3. Once they reached last quarter then they will make EB2-I/C current and distribute those spill-over visas across EB. They don't have to make EB3-ROW current to give some spill-over to EB3-I. What ever will be left at the end of quarter will be spilled across EB's.
I am expecting lot of REDs on this one.

That is not true, my lawyer who is very influential and he has some good contacts he told me that this year spill-over would be different form last year. I was stupid so didn’t believe him about July 2007, and paying it for now for not having EAD.
I know this is hard to believe especially if something comes from lawyer.

Folks I sent email to this address as stated "uscis-complaint@dhs.gov", got bounced back saying it as a wrong email. Does nay one know the correct email to send USCIS complaints to?

To be fair - India definitely has a competitive K-12 system because they are not all public schools (for free) like here. So the people who do get into IITs and RECs already have an edge.
Having said that - the Indian college education like Gayatri said is not as rigorous as it is here (and I am NOT talking about the IITs).
People pay a lot to go to college in the US and hence are generally more serious about their education. Fact is, a plumber can also make a good living here without a college degree. Its only those who can pay and are interested go to college. Ethical issues like copyright/plagiarism are also taken more seriously here and students are trained in critical thinking.
In all I think both nations have good and bad. I have to READ Wadhwa's report to understand what he is trying to convey. All I heard was 'apples and oranges and pineapples' from his talk.

Did get solved by Andrew Wiles in in the mid-nineties. To read about the history and drama behind this theorem, I suggest reading 'Fermat's Enigma' by Simon Singh. So I guess if that can be solved, PBEC could find a way out for all of us.

Received a direct deposit from IRS today of $1200. I am on H1B and my wife on H4 and both of us have SSNs. We had filed jointly.
Also another friend of mine received his refud for a family of 4 - he is on H1B, wife on H4, both have SSNs, one daughter US citizen (has SSN) and another daughter Indian citizen (no SSN). He got 600 + 600 + 300= $ 1500.
It all adds up...

Another soft LUD on the 485 on 11/26.
This is the 3rd soft LUD on the 485 (11/24, 11/25, 11/26) post sending AC21 and G28N documentation.
485 status still says Case received and Pending.
I hope this isn't followed by a denial, I have to travel outside the country in 2 weeks and it would be nice to not have to worry about this.

Hi gurus,
Can you please let me know your views on my situation where both my original APs are stamped at the POE when I went to India and came back to US. Since I do not have a third AP original, will I have to get one from USCIS or can I use these two stamped ones to return to US if I intend to travel in near future?
Is it possible to go to nearby USCIS office to get a new original AP?

I don't know if anybody has noticed it but the dates for EB-2 for VB October 2007 was April 1, 2004 and for VB October 2008 is April 1, 2003. That is a retrogression of 1 year - not good. :mad:
And then you must have also noticed that in Dec 07, it moved to Jan 1, 02.
Jan 00 in Jan 08, U in Feb-March and then April 03 in April 07.
With due respect, I don't think what you have observed really points to anything, either way.
Eventually, EB2-I will move forward, probably next April or so. And yes, this is all good old speculation, it doesn't mean anything really.

heres the thing..we have been talking about the 2004 hump for eb2 for a while now. if you download the perm data from 2005 you will see only 7000+ PERM approvals for India. this included a significant number of EB3 other worker categories like pipe welder, cook, etc ( i am assuming they were eb3 -other worker...correct me if i m wrong)

IV Core, please help members like us whose applications are pending at the Atlanta PERM Processing Center. In spite of officials informing that they will reassign their staff to process PERM applications a month back, there seems to be no progress so far. Please help us get out of this mess as our applications have been pending at this center for few months now. We would like to take this opportunity to apply for the next two stages while PD are current. By the way, I had an old case at BEC and got an approval. I just changed my job and reapplied through PERM, and then all of a sudden PD became current. I have been in this mess for 5 years now. It was just an unfortunate timing of my job change that screwed me up.
People from Chicago center have been getting quick approvals and are able to submit their I-140 & I-485 documents right away. But just because we live & work in the East coast, we are getting screwed. I don't think this is fair on part of DOL to penalize us because of our location. IV Core, please, help us.

I haven't received 45 day letter yet. My lawyer faxed twice to find out the status but no reply from PBEC. Is there any way to find out the status?Anybody here whose case is pending from 2001.
Typically they send replies after a month or so. So please be patient and give a month or two. Then you should see some info regarding case status.

I guess it's not a VERY GOOD IDEA THEN.
In all the docs that I went thru I could not see a difference between
"I-140 approved/I-485 pending and porting" and "I-140/I-485 pending and porting" (most docs refer to the latter).
I am guessing when it comes to "porting", both are the same in the eyes of USCIS??
(What I mean to ask is there any leniency with an approved I-140 and then trying to port?)
Anyone see otherwise?
