Received this e-mail from Tom Davis (Virginia congressman for where I live) today (Monday, July 9, 2007). Plan to reply by tomorrow mentioning it is not about "individual redress" rather a wrong imposed by USCIS/DOS on the legal-patiently waiting-community of immigrants. Any suggestions welcome.

Diptam, thats a tricky situation. I am not so well versed to know if Ombudsman's office will accept the form without employer's signature. let me check with few attorney's and the IV core group and get back to you.

What about the wild fluctuation in the bulletein?
Should we let these thing to continue?
What we are expecting after this calc. camp ? I dont think so they will revise bulletin nor they will give single extra visa above 140k. I think we should focus on HR 5882 .. We should send something to lawmakers.

We are fighting against anti-immigrant idiots like you.
Greencard is our right because we have been waiting long enough and paid a lot for it, and we will not just take greencard but also get our citizenship. My application was filed under PERM EB2 on May 12th and it got approved on Sep 2nd. Filed I-140 under premium processing yesterday. My attorney has requested earlier priority date (June 2003, EB3) while filing EB2 I-140. He said, once I-140 is approved and priority date porting is done, I-485 may be approved automatically. If not approved for a period of time (say a month or so), interfiling may be requested.

Is your case at NSC? I have definitely noticed a pattern of pre-adjudcation activity from NSC for cases filed in July-August 2007.
I noticed that too, especially if the PD is 2003 or 2004, both EB2 and EB3.

Instead of hiring a full time lobbyist why dont we hire a full time manager who will contact IV members and drive funding drives , organize campaigns , send and spam USCIS with emails flowers and faxes and keep it moving. Heck may be we can even offshore and outsource it. Take a look at YourManInIndia (http://www.yourmaninindia.com/) . At 7$ per hour this wont take much. Lets take the help of our brothers and sisters in Inda to get GC .. let them help us while we help them..

Your PD in EB3 for ROW will be back into track in October 2008 as its said in the current visa bulletin dated Jul 2008 for EB3 preference. So once it is back to current in October then the new visa numbers will be alloted. Then you will get your GC. So just wait till October to receive your GC confirmation.

i am not married. i have explored the possibility of doing this with friend(s) but decided that would like to do this independently. so i guess i have to figure out this owner/employee dual role problem.
any experience on this?
This is exactly why I am planning to open a company that can work as a pool for people who can use AC21, keep almost all the rate they are getting from market without having Legal Issues. I have atleast couple of people joining the pool immediately.

I have just talked local Congresswoman's Office and I have talked to a staff member for 1 hour and she is helping me. She is going to call NSC and get to the root cause of this problem.

My wife works in a company where a good number of IT folks are staffed by INFY. The poor quality of work made the company think about not extending INFY's contract. But then it came out in the open that there was no documentation on how the applications were built, etc. INFY got wind of this, and now they have positioned themselves in the organization where without them, this company's IT would collapse.
There are many such stories of outsourcing firms that are holding client companies hostage. Though I do not agree with the bill, I think the bill brings back some ethics into play. Especially the L1 loophole.
This is more of the client company's fault than Infys. It is upto the client to demand documentation for all the stuff Infy does. Infy will happily do that.
I used to work for an Indian IT firm in India in 1998 where our client was a major corporation here. The client used to demand so much documentation and follow stringent procedures that we were spending most of our time in documenting and following the procedures than doing the real work. This company did this happily without complaining. Client made sure that no company can hijack them.
So it is more of a management issue at client company in this case.
BTW many employees use this technique for their job security.

i sent all documents to loan officer at wells fargo for refinance. I sent I-140, EAD copy for immigration documents. just got email from loan office that he received my file back from underwriter and ask for greencard copy front and back as underwriter said EAD is not acceptable (Employer can not sponsor borrower).
could anybody please tell me what to do now?

May be they approve loan for only people who run away and screw up economy.
Try with a different bank.

Got approved just now. Labor filed EB3 on 23rd Feb Govt job. Thinsg are moving ... Best of luck to all !!!
