    I hope you are right and I am wrong. So, "special handling"
    cases do not go through labor certification at all. Do professors have to go through "special handling" labor certification?

    If you are right then it means that an advanced degree holder in STEM from a US school with 3 years of prior US experience will be able to apply for I-140 and I-485 right away.

    PD, please read my post above which you quoted more carefully. "Special handling" cases do go through labor cert, only they get faster better treatment. I am not sure of the rule of University Profs, refer to the post chain that I and Appu did earlier on this thread. I think Univ Profs don't do recruitment twice as is the case for the normal junta. They can use the recruitment results from when they first interviewed. But if they are not going the outstanding researcher route, they do have to undergo labor cert.

    I have been a passive follower on IV for few weeks now. I read the news clippings that people had posted where there was some Gautam Aggarwal who felt the point system was good. I see a press release from him that I saw floating around some mailing list.

    Quite honestly even though lots of us disagree with him, he does make a very valid point. IV should consider clubbing US educated people such that 2 separate quotas can be created. Instead of banishing him as an elitist look at his point he is making by just marketing how the country is using the educated. Using a well respected university name is no different than talking about how we legals pay taxes etc. Just because we are educated and better of that the illegals as an argument is no less than elitism in that sense. I happened to go through gautamagg's post after the Guitrezz rally - read his message again sans tone. He makes a point. This CIR bill could have been good for us if we approached it positively looking at US educated people as a group too. Also his statement on the AP report about MPS being good is not totally incorrect in an environment where both EB and MPS may exist - if we can get that i.e. EB and MPS keeps both sides happy and we should fight for that. I emailed gautamagg and he did mention that the AP report cut out that part of his statement and told me to verify that with the reporter if I wished to. I think we guys need to be less passionate before we throw stones at others. IV is definitely doing a great job but people should share opinions openly on strategy - we are all humans and we may have missed an important aspect at IV - most IV folks seem to be non-US educated consultants and therefore disagree with Gautam. We really are 2 diff groups who want the same result with better partnership. My 2 cents. His press release:

    “Grand Bargain” Immigration Bill creates issues for International Students in Economics, Finance and Business

    Mountain View, CA – May 28, 2007 – The US Senate is actively debating the proposed “Bi-partisan Grand Bargain” Immigration Reform bill. While the bill does have many provisions to attract educated people from outside the US, it also creates restrictions for people with an economics/ finance background.

    One of the proposals is to introduce an additional visa category for people coming to the US for graduate study. Though the proposed F-4 visa category is welcome by the international students’ community, it is unfavorable for people with a non-technical background or for people with a technical background who would like to gain additional skills outside of technology to be successful entrepreneurs. The proposed category, called the F-4 students visa, allows international students two major provisions that the existing student visa, the F-1, is restrictive in:

    1. F-4 students do not have to prove a non-immigration intent. Unlike F-1 visa applicants, students coming on an F-4 visa will have the ability to have a “dual intent” at the time of applying for their visa, while entering the Unites States, or while maintaining their F-4 status in the US. Such students can have a pending Green Card (GC) application or can apply for one while on F-4 status. This is in contrast to the existing F-1 category in which a previous or current intent to immigrate to the United States negatively impacts a persons ability to obtain an F-1 visa.

    2. Under the F-4 visa, instead of 12-months the students will have up to 24-months of Optional Practical Training (OPT) available after graduation. The larger time window will help students evaluate employment options while staying agnostic of visa issues.

    The bill restricts the F-4 visa to people who would attend advanced degrees in the fields of Science, Technology, Engineering, and Mathematics (STEM). Such limitation to STEM alone would negatively impact the inflow of international students to other graduate programs such as Finance, Economics, and Business. In today’s dynamic global economies, technology and business work together. Over a third of the MBA class in top US schools such as Wharton, Stanford, Harvard, and Cornell comes from a technology background. Restricting these provisions to STEM degrees alone will result in a severe shortage of highly skilled international students coming to the US for an MBA due to an advantage the STEM degree holders will have over them. This will impede the abilities of many “technologists” to obtain business and finance education and will reverse the positive trend in places such as the Silicon Valley where many engineers turn into successful entrepreneurs creating wealth and job opportunities for many Americans and add to America’s competitive edge.

    While the Senate has shown foresight by introducing the F-4 visa that helps in retaining people with advanced education from the US, it remains a very myopic solution to the problem it intends to address. Next week, the Senate comes back from recess to discuss amendments to this bill, this press release appeals to the Senate to consider enhancing the provisions of the F-4 as well.

    Note: Hundreds of people are affected by this already. With a Masters in Computer Science from Cornell University, 7-years of technology experience in the Silicon Valley, and after paying over $ 150,000 in taxes, Gautam, issuer of this Press release, may be unable to join his MBA class at The Wharton School this year. Because he had once started his Green Card process and established an “intent to immigrate”, it is difficult for him to reverse the process and obtain a students visa. Over 3-4 years of processing wait times has resulted in many people such as him to give-up their applications in lieu of additional education. But, their past intent looms over their very uncertain future: 22 of them have connected with each other and pray that their Indian Gods stay happy with them on the day of their student-visa interviews in India and that reason and common sense prevail.

    I would beg to differ on the issue of a Merit Based System being good for us and I have a US Ph.D in a STEM field with over 5 years of post degree experience.

    I have calculated that a Masters in Computer Science with 5 years experience will get more points than a Ph.D in say Civil Engineering because of two reasons (1) Computer Science is a high demand field and Civil Engineering is not. (2) A Ph.D may take around 6-7 years to get and by the time this Ph.D gets 5 years experience he may be touching 40 and not even getting the points allotted to those under 40.

    If you are a professor in Civil Engineering from India or China and even have tenure there is a big chance that you would not get a green card given that there will be a 10% country limit.

    Wouldn't you think that such a system would be seriously flawed or do you think that Gautam is correct I am myopic.

    IV may have a predominance of non US bachelors in its membership but most of its core have US degrees. So if you look at what IV backs you would find that even though they cannot fit in every individuals tailored requirements they very well realize what is for the greater good.

    To what one member said; we don't like it both ways. A question to the original poster. Had this been an emergency and USCIS delayed your EAD by three weeks, I bet you would be screaming and yelling at their inefficiency. Yes, the system is broken. Look at the bright side. At least an attempt is being made to fix it. If this were India you would be paying a hefty sum to God knows how many people to get something as simple as a birth certificate. And let me ask you one other question. When was the last time you picked up a phone and called your local MLA hoping that he or she will resolve the water problem in your area? Again, you would be paying decent money and runaround the MLA's private secretary to get ten minutes on the MLA's calendar.

    So dude, put-up or shut-up. Things are changing and if you want it any faster then you should give up your day job and dedicate yourself to the cause.

    If that is so then why isn't any Employment Based amendment in the list. and how does shusterman know. There is one from Sen. Mendez that gives more points for family but nothing for employment based.

    the writer's of this bill have said that any amedment that removes the merit system is a deal breaker. So far at least from whatever info is out there seems there is nothing for employment based category. Don't know if something is going on behind closed doors...

    Hi,

    As July visa bulletin indicate/predicted that for EB2-I it might reach up to March or April 2006 in FY2010.

    Is FY2010 is Jan to Dec 2010 or FY2010 ends at Sep 2010 for USCIS? My PD is Mar2006 Do I have to wait till Sep/OCT 2010 or till end of 2010 i.e. Dec?

    What is USCIS's Fiscal Calendar / Jan to Dec or Sep to Oct?

    I'm planning to go back to India so just wants to see, should I wait for 3-4 month more or it's going to be end of this year?

    I live in Lansing. However, I am out of town on 10/20. Can we have another option if it is not too much hassle for all of you?

    Another note- Troy will be very far for people in Lansing, Grand rapids, Kalamazoo, Battle Creek and Jackson. If a place like Farmington Hills or Novi is selected, it would be easier for people from the West side to come. Food for thought.

    I never imagined that the journey to GC would be such hard, and I have to give my whole life following these notices and EADs and what not. USCIS cannot approve my GC for years and years but now abrubptly they approved my EAD in less than 15 days, when I was expecting to get 2 years extension. My EAD app. was sent out on june 9th and my lawyer told me that they saw approval from yesterday 6/26 (wow 16 days including shipping!!!). USCIS always has hidden agenda, and everybody can tell that it is just money, which leads to such decisions. No body would forget last years july fiasco when they hushed up GC visa numbers for rendering people not to apply before fee hike. The present EAD issues everyone is reporting here is another fiasco. I wonder if there would be barrage of lawsuits for EAD fiasco as we saw last year for july fiasco. Now I understand why USCIS gave themselves time till 30th june, otherwise why wouldn't they make 2 year EADs effective right from the day of announcement in early week of june. Smart move!

    Oh well this is what we have to face till we get that "Gone Card"! Day by day my patience is losing. Is it worth all this trouble?
    i dont get it...the ead card is valid for a year. you are paying money for 1 year. Instead of being happy that your file has not been lost and have received your ead on time...you are going on a conspiracy theory rant.

    Just ask those people who havent received FP notices or havent received their EADs for the last 90 days, what they are going thru. At times we have to count our blessings rather than thinking what we have lost. the 2 year EAD is not your "right." Your "right" is to a 1 year EAD that you PAID for. If one gets a 2 year EAD, its a favor to them done by USCIS.

    I dont think one can or should DEMAND favors.

    It is terrible that AF treated its customer like a piece of Shi$. I have never flown nor shall ever fly in that crap airline.

    I would like to suggest one thing here. We (Indians), mostly, and I dont mean to generalize here, don't bother to "WRITE" letters to the company to express our dissatisfaction or frustration. Partly to blame for this attitude is because of the system we grew up in India where even if you complain we don't get any response, mostly. The customer service is lacking. So, in that mind set we most often feel its the same with other countries.

    But I strongly feel, sending a letter to express our outrage would definitely bring a positive change. The Govt. of India, should intervene but, lets not keep up the high hope, its not going to happen....they are all busy making money to buy land, home, comercial complex, marry their daughters and sons extravagantly and endless greed. So, realistically, the Indian Govt. is not going to intervene. Shame on them!!!

    Moving forward, I strongly urge all the folks in this thread who had a bad experience to write to AF and vent out your frustration and pledge not to fly with them ever again, and those of us who heard this story, just send an a mail to express the shock and question if we could also face the same situation should we decide to fly in AF.

    The poster who send a mail to AF with the "B" word, I applaud him. He even got a response!!! Wow!! that's the magic and strength of writing. Trust me it works. Just write to the airline, expressing or venting out your frustration. Just one line is enough, if you think its not worth the time.

    I felt like writing this comment because I don't want to be discriminated or treated differently(badly) because of my ethnicity or color.

    So, my friends, please go to this link (AF Suggestions page) and let them know your feelings.

    Thumb-up for the DC Rally! I think our efforts will be long-term. We got to get the idea across to as many people as possible. Rally is powerful, but we also need to use other types of campaign--big or small to get our voice heard.

    One idea my American friend shared with me was to make presentations at retirement centers or community centers/ events. We need to be visible and our contribution to the country made known.

    I wanted to volunteer a thought that had been in my head, so I am basically thinking out loud here for a bit, just throwing this out there for your guidance, tell me if you think this is too aggressive, or even premature?

    I think we need another rally before the end of the year. There are 2 reasons:

    1- Presidential campaigns: After this Fall, presidential campaigns will be in full swing, and thus commanding all the attention of Congress, the media and the American public.

    2- Memory: People's memories are short. Now that we have the attention of the media and Capitol Hill, wouldn't it make sense that this is the time to redouble our efforts and push harder? If we wait, the iron might just cool off.

    Having said that, and as we know, a rally means a lot of money, a lot of work, a lot of dedication to organize. Yet, no one said our struggle was easy, and other people and groups who have gone through tough struggles have had to go through extraordinary lengths to achieve their goals.

    So, if we were to hypothetically hold a second rally this Fall, we could go for the "low-hanging fruit", i.e. we can hold the rally where the most of us live, such as Silicon Valley (and we know those folks really come through), we can plan to reach attendance to this event in the tens of thousands. I know we might not have enough time, and the people who worked so hard on the DC rally are probably exhausted. But, what if we just focus on an area where there are a LOT of us, and do a "no-frills" rally? Just get the police permits and show up. Our numbers will do the rest.

    Thank you. Right after I'm done typing this, I am clicking on the contribution button to contribute towards this initiative.

    This will be in addition to the $200 I just pledged to help (airfare, hotel) members travelling to DC, and the recurring contribution that I'm signed up for since 2006.

    I am not wealthy, I don't have a ton of disposable cash lying around. I just want my green card, and I want it now. Actually no, I wanted it yesterday.

    If a few thousand dollars in advocacy contributions help me get my green card faster, and helps other qualified, deserving candidates in the years to come, I'll gladly invest in that karma.

    My last and final update to this post. I got my original Green Card (Cards not green color) It was the happiest day, the wait was finally over the air smelled a little better.

    My two cents - Have patience explore other means of getting green card if one doesn't work. An attorney once told me there are soo many ways and regulationsto get green card that half of them are not even in law manuals only the old timers know about them. Enjoy life life with green card and with out it is the same.but the time you spend never comes back. If you have problems with your employer just imagine if you didn't have a job. So make the best of your time and enjoy this great land which we call america.

    I had been there in US for 7 yrs (3 yrs in L2->1yr out of US->4 Yrs in H1B). Saw the myths and tragedy of US GC process very closely. Didn't want to spoil peace of life and my hard earned money with USCIS and lawyers:mad:. Didn’t look at the US GC application and applied for Canadian PR. Came to Canada with PR last year from US. Peacefully settled in Toronto with nice job and benefits, bought my brand new car 4 months back. Nice and friendly people and government. Happy to be in Canada. No more stamping issues, tons of junk paper works, consulate visit PA and wired look from immigration officers at POE…. enough…. I am not going back to US even for a visit in next 5 yrs..…

    But I can go out of Canada and enter any time and as many time as I want. Can you do that too???? :D

    To those who are portraying wrong picture of Canada, all I can say, if you have skills, personality and capability, you’ll succeed anywhere in this world, be it in US, Canada or Australia. Don’t blame it on a country, but look at yourself.

    Lot of people consider it below dignity to do something about GC related stuff, many just want to live they way they are, no ambitions, no motivation to work towards a change.

    ............- most of these wake up late in morning, go to work, watch TV , lazy in weekends , play cards, chat on phone , always spend a lot of hours on the internet researching for some crappy deals on electronic goods - the time, if well spent is worth more than what they save on buying the item.

    Chanduv23 , I know you are a very active member in these forums and feel very strongly about these efforts. I can probably understand your frustration, But I don't think we can embrace/attract people by alienating them.

    It is pretty broad generalization to say those who don't/can't attend the rally or those who does not have a positive disposition about the rally are bunch of lazy, TV watching , cards playing , bargain hunting , un-ambitious people.

    Let us move with a positive message. :) :) .

    so far, Senate Majority Harry Reid alsked the republicans to "stop" these things.. but we know they managed last year - so, if we don't do something, we may end up not receiving rebates this year also.. especially given the fact that Obama is trying to get support for this to pass in senate and not one republican voted for it in house...

    They hushed up and approved my EAD in 20 days. Why ???? 'cos So they don't hit Jun'30 and give 2 years. They wanted to milk another 680 from me so they hushed up and sent me the 1 year EAD in 20 days.

    I did a one time $100 contribution during 2007 Fiasco as i know it was all because of IV. I stayed away from Donating to IV after Donor - Non Donor fights.

    I know IV is doing wonderful job and i want to chip in here....Before that i want to know if this is separate drive or can i get Donor status?

    I speak Hindi and have 8-9 friends from south india..telegu, tamil and kannadiga........we have been hanging out for years now and we haven't faced any problems....2-3 ppl in our group don't know hindi well and they try to learn it.

    I have learned a few telugu and tamil words........I find calling the attitude of hindi ppl rude is a bad omen. If you don't like hindi, why do u like british language english.

    I'm surprised when ppl say they hate hindi (which many indians speak) but talk to the foreign clients in their language with a smirk on their face. Take it easy friends. Cool down.
