I agree, India is a far better option.
Assuming this discussion is about immigration/permanent-settlement and not about short term visits, work and study.
On the side note, The only problem faced in india is over population which triggers almost all other issues. If india implements onechildpolicy most of the problems faced today will disappear in few decades. Your child (note: singular) need not leave india to enjoy international level lifestyle & benefits.
As a backup plan to greencard advocacy we need to lobby the indian government to implement onechildpoilcy immediately.

I do not have paystubs from company B and C. If I have to reenter US, will that be a problem? Please help me out.
If you have to get visa stamping outside US then you only need to show paystubs for current employer. The CO will check if you have been in status throughout your stay in US and might ask you why you change employers so many times.

Sorry to be rude guys, but if you are a new EB3 India. "post 2005 perm". I would advise you to seek greener pastures in UK or India. I dont see a light at the end of tunnel as things stand today
I don't see a future with EB3. If you have your EAD and AP and have a dream for future. Just use EAD and do it. Save money and in the worst case go to India or UK. But live LIFE WITH PASSION.

I recently sent a letter to the USCIS Director Explaining the problems faced by H4's because the stay in H4 counts towards the H1 time. Just to bring up the matter of Decoupling H1 time and H4 time. May be it was long forgotten in the bureaucracy.
I couldn't find an email address of the USCIS Director, Not even a full Address.
I used the address below. It might reach there or come back to me.

I had my H1b till Nov 16, 2010 with Company1
Company2 applied for H1b transfer and it was approved as of Nov 08, 2010 ( but we didn't get any notification about it it's approval until few weeks later)
Company1 filed for H1b extension on Nov 10, 2010
I properly resigned Company1 on Nov 30, 2010 and started working with Company2 on Dec 1, 2010
Somehow Company1 didn't terminate my H1b extension and it got approved as of Jan 18, 2011.
1) Which status am I in? What decides my status?
2) Can I continue working for Company2 without any problems? Has this new approval put my transfer in jeopardy?
3) Do I need to update Company2 about Company1's extension approval?
4) Do I need to leave the Country to do any stamping?
Please help!!

You definitely raise an interesting case. What I would say to that is that they just have to reevaluate the points allocation system. the details of the point allocation system may be bad but the overall intent still stands to benefit the highly educated while including the EB system as well will make sure less skilled but in demand people are also taken care off. handling family based GC is a whole diff ball game though.

I have a few questions regarding the application for AP for a dependent, and I would appreciate it if someone would answer them.
1. If the dependent is applying for AP, should I include the primary applicant's I-485 in the application packet?
>>> U mean 1-485 receipt notice then no, just apply the dependents i-485 notice
2. The dependent has an EAD. Is it necessary to include copy(ies) of the EADs with the AP packet?
>>> Yes, it shows the current status as on EAD.
3. If the previous AP has expired, is the applicationo process for a new AP different from that if a non-expired AP is being renewed?

4. I was reading in some threads that the $305 fee will be waived if there is a pending I-485. Is that correct?

So I have trickled into 152 tonight. I thought I'd try my hand at campaigning at some local places and managed 3! It seemed a lot harder than I imagined, I think I need to work on my introduction and smile ;) All three folks looked scared and suspicious of me but atleast they signed! Not giving up hope though! I have some others in the works via some good friends and I am going to try and tap more immigration law firms in SF. I am still pledging 200 and hope for more!! Any tips on campaigning to strangers, and I will be set! Thanks guys.

Apart from Deniel notice I also got LUD on I 140.
Could it be related to old employer revoking I 140?
Since I have transfered after 180 and did Ac 21 - am I covered.
Prince - Did you get any LUD on 140 on the day you got this deniel e mail?

I�ve been laid off as of Friday last week.
My employer started laying off people an year ago and there were too many cycles so far. I was immune to all those layoffs until Friday. They eliminated everybody in my team, 15 people in total.
I am in the final stage of my GC and I have 2 year EAD. My H1 is expiring in March and my (ex) employer already paid my Attorney for the 3 year extension. They have decided to extend my H1 and paid for the expenses. But in the mean time, they were forced by the investors to show profitability and hence the layoffs.
My (ex) employer is based in Massachusetts and my Labor Certification was done from this location.
I have received job offers from some of my employer�s clients. However, they are based in other States (CO, OH & WA for instance) and they might not be able to do my H1. One of them is interested in hiring me on a contract basis, since they had frozen new hiring.
Is taking a job outside of Massachusetts impact my pending I-485? or Will it violate my Labor Certification conditions? I couldn�t find an answer for this anywhere.
Also, can I take contract jobs for the time being?
I sent out an email to my Attorney with all these questions. But, he is not available until Tuesday next week.

As we enter the final 15 days of our advocacy days preparation (http://immigrationvoice.org/forum/showthread.php?goto=newpost&t=1437978) we would like to thank our members that have indicated that they would be coming to DC on June 7 and 8. We also want to thank all State chapters, volunteers and action item leaders that have been helping out with the effort behind the scenes. The massive planning, coordination and implementation cannot happen without the support of each and every member. Help has ranged from phone call campaigns, media campaigns, lawmaker meetings, document preparation, state chapter activities, accommodation initiatives, reaching out to various employers and like minded organizations etc.
We still have a long way to go in our coordination and implementation. IV membership is working hard to make this event a success. The advocacy day work is being implemented at this time and lawmaker office appointments are being sought. Everyone that has indicated their presence for this event will be contacted personally. We are planning an impressive congressional reception event on June 8, in DC and expect several lawmakers, staffers and leaders of other like minded organizations attending the reception. It will be a great opportunity for IV members to meet these important representatives. There is also going to be a notable Press event on June 8 that we are planning. There are several initiatives being taken that we will be announcing in the days leading up to these events. The event is in itself a huge task that requires planning from getting space for various parts of this event, space for gathering of all IV members (situation room) to transporting all advocacy day material, providing training sessions for members, getting appointments from lawmaker offices, inviting reporters, press release to details like photocopying documents for each meeting, folders and digital advocacy media with IV branding and soft copy of all IV documents as a leave behind in every lawmaker office.

These emails, letters and communications will help us with more effective and targeted advocacy to help get much needed attention for our issues. We are a small grassroots organization with a strong resolve and when we all pool in our energies, intelligence and resources; we can all collectively create wonders. We do not want our limited funds to stop us from going all out. Despite our fulltime jobs, IV core is committed to work harder and we are happy to have the asset of a large IV community to support us in this mammoth task.
