    I have been thinking about whether to attend the rally or not from past few weeks.

    Attending the rally would require me to take a day off. Finally today without thinking twice I just went to my manager asked if I can take day off on 9/18 instead compensate the work in the following saturday. It was approved and I am attending the rally on 9/18!

    I am feeling so good now.

    Well...I am one of us stuck in EB3. I do qualify for EB2 but my employer choose to file it under EB3. I recently invoked AC21 and moved over to a new employer on my EAD. Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?

    If you have read this post you have also read that IV won't inform which firms that they are going with, and the change is because of contract expiring. Please stop letting your disillusionment affect ur judgment. All people can do is join state chapters and contribute more. If you feel this leadership is going nowhere why don't you give up some of your free time and do some active work and contribute more.


    ok, i am beginning to lose confidence now... first no i-485 relief and now wait till CIR>.....last year, CIR turned out to be a big circus....i hope this time something productive happens....

    Can you please explain how is this related?
    Our I-140 has already been filed but we dont have receipt notice for that.
    We are wondering how to file I-485 without I-140 receipt notice?

    Purpose of Form
    To petition for an alien worker to become a permanent resident in the United States. This form is filed on behalf of an alien, and not by the alien.

    Who is Not Eligible to E-File This Form
    You are NOT eligible to E-File this form if:

    You are applying for a waiver of the filing fee.
    You are requesting that your case be expedited (does not include filing for Premium Processing)
    You are a Soviet scientist
    Who Is Eligible to E-File This Form
    Any other alien, except those listed above, may be the beneficiary of an E-Filed I-140 petition.

    Initial Evidence and Supporting Documentation Required
    See Instructions to the Paper-based Form I-140.

    If you are required to obtain a labor certification from the Department of Labor, do so prior to E-Filing Form I-140. The original Labor Certification signed by the filer and certified by the Department of Labor must be submitted with supporting documentation to the Service Center that has jurisdiction over your case. See your Confirmation Receipt Notice for the Service Center's mailing address. The required initial evidence must be received by the Service Center within seven business days of E-Filing the Form. If you do not submit the required initial evidence in the requisite time period, you will not establish a basis for eligibility, and we may deny your petition or application.

    Concurrent E-Filing
    E-Filed I-140 petitions can only be Concurrently E-Filed with the following applications under the following conditions:

    I-907 application: Only if the I-140 beneficiary selects Petition Type "e" - A professional (at a minimum, possessing a bachelor's degree or a foreign degree equivalent to a U.S. bachelor degree) or a skilled worker (requiring at least two years of specialized training or experience) in Part 2. For all other petition types, the e-Filed Form I-140 is not available for premium processing.
    When E-Filing an I-907 concurrently with an I-140, the 15-day Premium Processing guarantee will not begin until the supporting documentation for the I-140 is received at the Service Center that has jurisdiction over the I-140.

    Submitting Supporting Documentation

    Supporting documentation is the initial evidence that is required as proof of identification and as justification of eligibility for a benefit. These documents are required for USCIS to make a decision on your application. Examples of supporting documentation include copies of birth certificates, marriage licenses, Permanent Resident Cards, etc.

    Check the instructions for the form you are E-Filing to determine what supporting documentation, if any, is required.



    Instructions for Submitting Supporting Documentation for E-Filed Applications Only

    Review the instructions for your E-Filed form to determine what supporting documentation is required.


    Please Note: If you E-File Form I-90, you must submit all required initial evidence and supporting documentation at the time of your in-person appearance at your local ASC. Please see the Form-Specific Instructions for E-Filing I-90.

    Gather your supporting documentation for your E-Filed application.
    Originals and Copies. In almost all cases, submit a photocopy of your supporting document to the USCIS. For more information, see How Do I Know If I Need Original Documents? If form instructions state that a copy of a document may be filed with an application, and you choose to send USCIS the original, USCIS may keep that original for our records.
    Translations. Any foreign language document must be accompanied by a full English translation that the translator has certified as complete and correct, and by the translator's certification that he or she is competent to translate the foreign language into English.

    Generate a copy of the G-28 (it will be generated as part of the PDF file application after you click the �Finish� button).
    Confirm that the Applicant/Beneficiary/Petitioner name and address information does appear on the G-28.
    If the Applicant/Beneficiary/Petitioner name and address information does NOT appear on the G-28, print out the G-28 (it will printout with the PDF file application).
    Make a copy of the G-28 for each application electronically submitted.
    Fill in the Applicant/Beneficiary/Petitioner name and address information by hand.
    Sign each G-28.
    Submit the completed and signed G-28s to the address on the Confirmation Receipt notice with the required supporting documentation.

    This is a different employer, so I am assuming it is new H1. If I remember correctly from my past research, H1 is always NEW when you file it with different employer, but I am not 100% sure....

    I think it is very simple to understand. It clearly says it's free for people who filed their adjust of status application (I-485) under new file structure. Since we(most of us) filed under old file structure, we'll always be paying $340. Point numbers no. 5. is about AOS application and not about EAD appl.

    Yes , its Free :D Anyway - lets talk with a 3rd person (maybe USCIS) and confirm. Its Free, if you read the EAD forms its clearly written that once some one pays $340 ( not other amount) it becomes FREE for ever. I just checked the EAD forms again before writing this post - let me PASTE from EAD forms if that clear the confusion.

    Renewal EAD: If this is a renewal application and you
    applying under one of the following categories, a filing fee
    not required:
    1. (a)(8) Citizen of Micronesia, Marshall Islands, or Palau;
    3. (a)(11) Deferred Enforced Departure; or

    Oh Boy!, I feel like hugging you (Jadu ki zappi). By the way my story is very similar to you
    Came to USA in 1999 to do MBA from a top US school. Joined a multinational org in 2001, filled my labor in 2002, got laid off in 2005, Filled my another labor in 2005.
    But look , I am cool!:)

    Frist, sorry for the confusion. I do have a 05/2007 PD at Atlanta PERM center. I came to the country in 1999 for grad school, started working with OPT in 2001, converted to H1 in 2002, laid off in 2002, started working again in 2002 with a new employer, filed labor in 2004 and got stuck in BEC ever since. The employer refused to file PERM, so I had change to a new company in 2006, and had PERM filed in 2007 and got stuck there again. Your are right, I am technically not in BEC, but psychologically I always feel I am in there.

    I did not know what was 'disruptive' and 'inappropriate' about what I said. This is a board for BEC victims, so BEC victims are not allowed to express our frustration? I just expressed my depress and my concerns over how much this will retrogress the PD without targeting anyone. When tons of people run in front of our queue and shut us out in cold, we are supposed to 'enjoy the moment' with them? If so, when USCIS said no one can file 485 on July 2nd, why none of the people enjoy the happiness with those who already filed, because that will make their processing time much faster. People said we should feel happy for those who can file, because they now can get EAD/AP for their spouses, as if our spouse do not need EAD/AP. And as a result of this total mess, I don't think we'll have hope in another several years to see the date current.

    IV core keeps telling us, BEC is always on their agenda. Really? If they did not even understand our pain and consider our frustration a disruption to people's happiness, how can we expect them to help? I still think IV is a great org, as it's the first such organization to speak out for legal immigrants. But when it comes to BEC victims, I did not see IV changed anything, or intend to change anything.

    You guys are doing a good job. My question is.... will 252 contributions / month be enough to support the new initiative??

    Is there a way we can have access to the tel no. of non contributing members ?????????????????
    The target is 1000. IV core group is not asking for funds now because we have done all we could to make our case and we have reached a ceiling. Now, it has to come from the heart of the members and if they feel we are doing the right thing they will contribute. We had all kinds of nasty posts whenever we /members started asking for contributions. Yes it will help when you call your friends. No we dont have phone numbers. Only few people put their phone numbers in their profiles. most register annonymously and a lot of nasty posts come from such members. Despite repeated requests most members have not updated their profile with contact information.

    When M.K.Gandhi held his first rally against the British rulers(nothing personal here Franklin and Mark :) ), it did not result in immediate freedom, but was it worthless ?

    It's not just India that won freedom either, don't forget USA!
    Although I do admire Gandhi's approach more.
    STAND UP AND BE COUNTED.

    If Britain still ruled India, I'd probably be marching with you in India!

    What would rather you tell your children, "I sat at home and read the forums", or "I marched in the streets".

    If my attorney is to be believed, USCIS will clarify on Wednesday regarding whether/how to file without receipt notice.

    BTW turns out I'm with Nebraska SC too. I had just assumed I would be in TX given that I live in TX! :D


    Lets wait till Wednesday then.
    I still believe we should be able to get the receipt numbers by 1-Aug.

    I agree with the OP that Air India is one of the worst airlines for service. I have travelled a lot in AI due to company policy peviously.

    Now that I dont have any obligation, I always prefer Singapore and Cathay pacific. They rock!!!

    Excellent service (specially for elderly people and kids), fresh food and reasonable prices.

    was your first labor PD before April2004?
    If yes,then they might have taken that PD.
    If not,maybe we can see a forward movement for PD for EB2 in coming bulletin as USCIS might be trying to use as much visa numbers as possible.

    No its I-485 I just cut and pasted the two emails I received, first at 10am then the second at 3 pm check online and the system had same messages. If its true I am having a party wow man thanks I did come to US in 1997. I do have a labor which was approved under RIR PD date 2004 but the employer refused to file I-140. Then again filed PERM in 2007 under EB2 and filed I-140/I-485 based on this PERM

    can any one help me i left my company and i joined another company (h1b transfer rec date was 3/13/07 and still pending is this normal ? if my previous company revoke my visa after the new copmany filed for the transfer will this be a reason for ins to deny my h1b transfer? please help

    Mirage..you are absolutely right...i paid 765$ as per old fees for I485,EAD,AP. the new fees for I485 is 1010$ and EAD,AP can be concurrently filed with no fees.also, since I485 is filed with new fees there will be no fees for renewals.so, basically 1010$ one time fee with the new fees structure and 765$+645$(EAD+AP) with every renewal every year.(if it becomes 2 years then for every 2 years).i wish i had paid thru new fees.this is completely unfair and big BS......
    my 10 cents to this discussion.
