    The Crux of the matter is 'Indians discriminate Indians !!!!'. You see that everyday.....

    1.Indian embassies in US...
    2.Air India service is better for Goras and Goris than us...
    3.Even in a website called IV and the list goes on and on.

    Its been long forgotten that we were once the richest country in the world with a amazing history and cultural background.

    Bottom line: Once a fellow Indian starts respecting another fellow Indian 'others will follow'.

    Hi gps001,

    I have same question. I filed I-485+AP+EAD in July fiasco, after one year renewed I-131 (paid the fee then). I remember from that time that I do not have to pay the fee again to renew it. But in the e-file form I am not seeing option to get the waiver. Now I am doubting whether 2nd renewal is free or not?

    I believe you have to pay the fee again to renew. If you applied your AP after the new fee structure kicked in, then you don't. But most of the July fisaco filers have to pay the fee for renewal as the new fee kicked in after the fiasco.

    People that have been saying that IV supports this and not that please re-look at IVs agenda, nothing is hidden. The stated agenda is to try to make the employment based process better, the ENTIRE process. A piece meal approach does not work (proven in the past by legislation that tries to fix a portion of the system). The holistic approach may appear to be locally sub-optimal will be the best for the entire employment based community.

    In the interest of full disclosure and at the risk of incurring more back lash I must state that I am in EB2-I category.

    In this case the Eb3-I tattoo is more like a tramp stamp :D based on what is happening to these folks now. I know, I am one of them :rolleyes:.

    Actually some of concern of EB3 is valid.But their explanation cannot convince DOS or USCIS. According to DOS/CIS EB1 has more skills than EB2 and EB2 has more skills than EB3. That is not true in many cases. EB1 most cases are genuine except some cases in multi national managers. A manager in CTS could file in EB1 but at the same time similar manager in Intel cannot file in EB1. But only very few are in numbers because of restrictions like working in other country branch etc. So people do not bother about EB1 being current always.

    Coming to EB2, the job requirement require Masters or 5 years experience. If the requirement is genuine then it is ok to give priority to EB2. But in reality(mainly consulting companies) the job requirement is decided mostly in Lawyers office or by candidate just because candidate has
    master degree or 5 years experience. Though CIS scrutinise the EB2 applications still rejection rate is less. And also many persons trying to use 3 year degree and 2 year Master and apply for Eb2 by adding PG diploma etc.
    So it appears that there is no difference in skills between EB2 and EB3. If CIS and companies follow strictly the law and good faith then number of candidates would have been less in EB2 and EB2 would have been current and remaining would have been transferred to EB3. But these reasons could not be given to DOS/CIS. According to DOS/CIS EB2 has more skills than EB3.
    Good post . And there is no basis for anyone to accuse IV of being anti EB3 or anti -anything immigration related . It's a truly fantastic organization .

    That said, EB3's concern are real and not based on Jealousy. Everyone should support recapture effort but I do not think that is the only solution.

    Challenging/airing concerns over DOS 's spill over distribution is a valid issue too. May not be as important as recapture issue but still important like 2 year EAD/AP,s etc.

    I guess the cat is out of the bag. Yes, I got my greencard a few weeks ago. Yes, my PD is early 2004.

    There are 2 current theories why:-
    1. I'm very vocal in the media and lawmakers about the problem, and something made this happen (as my co-workers say "they gave it to you to shut you up")
    2. I was a lucky one that was assigned a visa number in early June (when I applied for AOS) - it was approved when my PD was not current.

    I'm not going anywhere, nothing has changed with the current policy. It is still broken. If for no other reason, the bizarre circumstances around my GC highlight more unpredictability and uncertainty in the whole process. I hadn't mentioned it before since it really isn't a big deal in the big picture.

    Congrats.. and good to know that inspite of getting GC you have decided to stick with non-GC holders like us...

    Again, Thanks a bunch Desi3933. My case is pretty much same as 'Scenario 1' in this Murthy document.

    Desi3933 cleared the 99% of the cloud surrounded this issue by pointing to murthy.com (I maintained valid status with 'Employer #2' and this doc says I am good to go). Thank you very much Desi3933.


    Apologize for extending the topic....but one of the 'still open' question is what if the Second Employer H1B is 'NEW' and what if it is 'Transfer'.
    Murthy document does not say about the Company B H1B is NEW or TRANSFERRED.

    If New H1B and Transferred H1B are same....then problem is solved.

    Many of you here said both are same. I assume so too. But, we haven't proved Gapala is wrong yet (no hard feelings gapala. it is not my intention to hurt you). if 'NEW and TRANSFERRED' are different, Murthy should have mentioned in her Document, but she did not do that. So, can we safely assume, that 'NEW and TRANSFERRED' are same.

    Come on man....there is nothing called transfer. Every H1B is new. Only thing is its not counted against the cap when you change the employer.

    I m a new applicant for EB 3 gc born in india.....just starting my process......with my PD being sometime in later half of 2009,do u think canada is a better option?......EB 3 india right now looks like a good 10-12 years wait time!!.......pls advice about canada immigration and is it a viable option?

    You stand a better chance of getting it through your kids if they are citizens than getting it through EB3. There are a few options to get green card faster. Canada is not one of them.
    1. Get a Ph.D, get a job in a univ and apply in EB-1.
    2. Get a MBA and get a management job and apply in EB-1.
    3. Become a religious worker in some temple and apply in the religious worker category.

    I was 100% determined in the beginning to attend the rally, but could not for the following reasons.

    1> I was in Dallas and family in SoCal for last 9 months(from Dec 2006 to be precise). I used to meet my family every other weekend. Was trying very hard to find a project in Socal, and finally I got one where joining date was Spet 13th. I could not dare to ask for leave in the very first week. To tell you the truth it took so long b'cos of H1 status, everybody wants me to transfer my H1 or they are looking only for GC/EAD holders. Hoping to get EAD soon.

    2> My husband was planning to attend but somewhere in Aug last week we got FP notices and date is Sept 18th. The FP letter clearly mentioned that postponing might cause delays so we decided that he also has to drop the idea.

    Of course we contributed towards the rally.

    I am very proud to be part of such excellent grass root organization and now since I am in Irvine I can be active in Socal chapter.

    Also we are eager to join in the next rally and have total faith in IV leadership.

    Well...I am one of us stuck in EB3. I do qualify for EB2 but my employer choose to file it under EB3. I recently invoked AC21 and moved over to a new employer on my EAD. Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?

    Sorry , but I dont think that it is possible to do that ...
    EB3 vs EB2 classifications depend on Job Description ie the description and education, experience requirement given at the labor certification stage.
    You can get labor certification which would satisfy EB2 class requirements and apply under EB3 for I140 .... but not the other way around. ...

    That means starting from scratch with PERM with a new Labor... loosing PD and back to square one ... obviously not worth it

    sc3, First of all let me express understanding of your agony and disappointment. If I were in your situation, probably I'll be talking like you.:)

    You recite several unfair things. Who said there aren't any unfair things around? IV has feeble power when comapred to the massive muscle and money power of various lobbies who are stacked against us. In this context saying things that could undermine the unity of IV members can only further undermine any future efforts. Are you saying IV should "rat out" these people who have fake jobs and work for body shops?


    A very dissproportionaely large number of EB3ROW and EB3I were adjudicated last June 2007, one ecould say at the expense of EB2-I. It is not unreasonable for EB2-I members to feel this way.

    The question should be what to do now? There is no other way than lobbying for recapture bill.

    I guess I got carried away with so many people saying that Eb3 are pained only because EB2 is getting ahead -- which is blatantly untrue. Most of us are pained because of the long wait, and the prospect of more long wait to come. Eb2s getting or not getting their GCs doesn't necessarily register on our emotional scale, when we are looking at our own situation.

    Further what really gets to me (putting it in a civil way), is that some people make use of obviously illegal things and then lecture us that we should be "happy for them" and "we should support them" (maybe they are not the same people, but some part of the problem can be attributed to this situation).


    Well if the jobs are fake, then IV need not rat them out, but with people saying the law is implemented right, maybe we should help in implementing it in a more "righter" fashion. Why not? I was just trying to point out that people who are poo-pooing us need to look at their own legal standpoint (that is not to say that I consider any of the poster who is going vitriolic against us to have used that method).

    Sorry, you probably did not put it that way, but it comes out as, we suffered yesterday, so you guys should suffer today. If that is the case, then solving the immigration issue should be the last on our minds, since we have suffered this long, maybe all the future applicants should suffer just as much.

    But I am sure you did not mean it that way.

    OK we may be in slight uncertainty now but if this bill comes up most of us will be in deep shit:

    No H1b consulting;

    change in h1b policy no new, no extensions, no transfers (crazy regulations thanks to Sanders and Durbin)

    No H1b for medical residencies

    No NIW for physicians

    Nothing for nurses

    US masters and other not H1b cap exempt

    Worse retrogression (no relief)

    Disaster for pending L certification and pending I 140s

    No EB1 for outstanding aliens

    New useless point based system (look at the point based system in Canada: PhD and masters are driving Taxis... ha!)

    We must pray that this bill dies FOREVER.

    We will be happiest then.

    All,
    Is LUD mandetory after finger printing? I applied for EAD for my wife and me on 5/21. Sent supporting docs and had LUD on 5/23. Went for finger printing on 6/10 but no LUD so far. I am concerned if the finger printing center sent the data to USCIS or not. Our EAD expired 7/30 so I am concerned.

    Update: In the subcommittee hearing tomorrow let us expect our issues raised. IV has successfully communicated issues of IV community to the subcommittee members. Let us wait to see if all of those are addressed in questions. This is all possible due to support of members who contribute to help us with lobbying efforts.
