    I requested (actually begged) my employer and attorney to pursue EB1 as well - they said no - lawyer's response is EB1 is very difficult and you should be someone of nobel prize calibre etc.etc.
    ...
    I went ahead with another private attorney to submit another EB1 I140 separately which is still pending.
    I understand your self-petition is in EB1-EA ("extraordinary ability") category, right? If your employer's lawyer had to file EB1 on your behalf, she/he had to do this in either EB1-OR ("outstanding researcher") or EB1-ET ("executive transferee") category, depending on whether you are employed in academics or industry. That may mean more paperwork for the lawyer and/or expense for the employer, which might explain their reluctance in pursuing that option. And in general, a lawyer hired by your employer does not always have your best interest in mind (unless it coincides with the interest of your employer).

    Excellent response. I have been a silent admirer of IV for some time. IV has represented the aspirations of all the EB applicants. people should understand that the US allotment of visas to foreign Nationals is only based on what is fair for the country (US). It does not matter to them to what country the applicant belongs but what matters is the qualifications and their benefit to the advancement of the US. I am appauled to see some of the members racheting up this irrational discussion about the spillovers when DOS clearly stated recently what the intent of the law was. the sooner they get over this issue, the better for them and for every one on the forum as the existing rules will NOT change regarding the spillover. we have to concentrate our efforts on how we can improve conditions for every body affected by this retroression. efforts aimed at one category and that too one country will almost certainy fail. I am also shocked to see a few EB3 I expressing anger over dates moving for EB2. personally if I see a person from my country getting his visa approved, then I would feel very happy for him even if I am waiting for some time. I know it will be difficult, but atleast spare some joy for your country men and women who are getting some well deserved relief after such a long wait. one of my old friends told me once "if you have a friend from India, don't rely on him to help you, because you will not get much help moreover some people will only try to pull you down, but if you take people from other countries, it is exactly the opposite as they try to help each other in every possible way". I agree that it is very distressing for every one that the dates are retrogressed, but now that EB2 has moved, all of a sudden some people woke up from a deep sleep and started making these arguments that have no legal basis. None of these people expressed their anger when EB3 ROW was being preferred over more qualified EB2 I and C and making EB2 unavailable. I know a lot of people from EB2 protested at this wrong interpretation of the law, but I don't remember anyone ever criticizing IV for not taking up their cause even though we knew all along that spillover from EB1 to EB2 retrogressed countries was the right interpretation of the law. now some people are asking IV to take up an issue that is straight forward illegal as was clearly explained by DOS in a recent bulletin. instead of wasting time and efforts on such futile suggestions, people should concentrate on making some constructive effort along with IV helping every one involved in retrogression.

    aman kapoor is the president and founder of iv- of course you can argue he now has his GC but that fact is he is still the heart and soul of iv and runs the organization on a day to day basis. he is EB3.

    the "core group" does not much exist in practical terms right now. there is instead a large "leaders group" that helps coordinate actions and strategy.
    this group has a lot of active members- and i find it "comfortable" to say that the majority are EB3. which may actually count for something- since i actually do know somethings you don't :-)

    no one stops anyone from doing anything. but whatever you do (and yes you actually have to DO, not just keep talking), has to have a sound basis. Many of the suggestions put forward have flaws, and actually papu and others have been pretty helpful in politely helping to point those out and suggesting changes. of course reddog took objection even to that! incidentally, just for the record, you may want to look at pappu's profile . HE IS EB3!

    so what do you want anyway? should we go tell USCIS that leftover Gc from EB2 ROW should go to EB3 ROW instead of EB2 I/C? what about the 28.6% that should belong to EB2? and since you are EB3 I- how does this help you in any way? or should we tell them to stop the preference catogories in INA and make EB1=EB2=Eb3? somehow i do not think that is going to fly.

    where were you when USCIS implemented vertical spillover in 2006 and left EB2 I in a U state while giving EB2 Gc numbers to EB3 ROW?
    did you object then? did you start a campaign? did EB2 I folks here start saying that iv did not care about them?

    in 2007 ordinarily, (like 06) EB2 I and EB3 I would have got only 2,800 GC each. because of iv's efforts in reversing the july bulletin, EB3 I got a huge number of Gc instead. many more than any other category. i don't remember anyone else standing up and saying that this was unfair and that iv is all about EB3I. and that's what a lot of anti iv folks say. that iv is all about EB3 India. so this is very ironical.

    and i see here a comment that every campaign has been bad for EB3 india.
    i guess july reversal was bad. i guess the campaign for recapture is bad. and the 2 year EAD is bad too. not to mention the gathering support to end country quotas.

    lets format a reply saying that 5K is too much for the job...if they can give us their Data Model diagram, we can give them the code in a week without any cost.

    One reason for the poor performance from DC area folks is that a GC does not open many avenues for folks in DC area. You could change from a 70K job to 90K job, may be. In Silicon Valley there are many more opportunities. You are talking about a change from 80K to may be starting a million $$ company.

    December Visa bulletin is obviously frustrating for all of us. After the recent accomplishments in July visa bulletin and the tons of approvals that we saw after that, we hoped that everything will be alright.

    But that did not happen. Some of us in the community were taken by surprise, but this was expected. Afterall there are only 140K greencards available every year. EB2 for India and China is already used up for the quarter. EB3 is badly retrogressed for everyone.

    Believe me, it will not get any better. It will get worse with time if there is no immigration reform.

    IV can only do what its members empower it to do. If members want us to be just a site for question and answers for individual visa problems we can stay like that. If members want us to come together and do a rally in DC, we will help organize it. We did a rally in DC on Sept 18 and made great progress. However we cannot just sit back and admire one effort. We need to continue it and capitalize on it.

    Now is the time for everyone to decide if they want a greencard. If you need a greencard, and want to do something about it, then you must join this effort and help yourself by helping everyone.

    Our Plans

    Our next hope is year end bills. If we can get some provisions in those bills we can certainly look forward to a happy new year with fast movement of visa dates. Next year is an election year and it will become much tougher for any immigration bill to pass. We will need to make super extra push next year for something to happen. So the time to act is NOW.

    One way to think is; this forum is for people who want to do something about their state of affairs, and don't just hope that other's would fix the world for them.

    if one has this attitude, then only confidence left to loose is one's own.

    The other way to think is, damn, i gave $50 and still nothing happened.....in this case, let's hope Santa Claus are for real.

    united nations...u have been saying what u just said for many years now. i remember ur epic fight with saras on that issue that caused u to leave immigration portal.

    i think this modification of the interpretation of the law is mainly to prevent the massive loss of numbers. I think the DOS now realizes that USCIS cannot effectively handle processing of the massive release of visa numbers in the last quarter, thereby they are doing it in an incremental manner so that the demand is handled effectively (USCIS standards effectively).

    I agree; the law definitively leaves no room for error. If all the visas are held back until fourth quarter then there is a significant chance that visas will go unused.

    However; it isn't in uscis/dos discretion to make such decisions on a whim for process improvement.

    In the orgnizations we work in; there is a big consideration whether the new project or idea is feasible in the current environment. If it isn't then the project/idea gets shelved because it's not doable. However; congress and various regulatory bodies do not give such luxury to uscis. They don't ask them if the implementation of a law or creation of a law will fit into their system or workflow.

    At a high level; country quotas in EB do not make a whole lot of sense. I have tried to figure out why they are there; how companies and candidates use EB greencards. Conclusion, I came up with is that in a lot of ways EB is a way to circumvent family base immigration. Many peoples parents have greencards, brothers, sisters, friends, etc; and they realize that it takes too long to get greencard through family base and the fastest way is to come through h-1b and go through EB route. Also; companies; company owners will favor their own people in filing h-1b's and greencards and then you have a situation where certain people are favored due to their nationality or connection. I firmly believe that uscis and the regulatory authorities understand this and hence the reason why there is country quotas.

    Option 4- Stay in H1-B status for 9+ years and you will become a religious person automatically.. after 9 years you will reach a level where no country, no citizenship, no relationship would matter....only MURTHY JI would matter.

    It is my own experience.

    You stand a better chance of getting it through your kids if they are citizens than getting it through EB3. There are a few options to get green card faster. Canada is not one of them.
    1. Get a Ph.D, get a job in a univ and apply in EB-1.
    2. Get a MBA and get a management job and apply in EB-1.
    3. Become a religious worker in some temple and apply in the religious worker category.

    I absolutely do not agree that it will do more harm - given the current situation where every country is backlogged in EB3, and EB2 for India/China is also severely backlogged, there is very little chance that India and China can have more than 10000 visas (7% of 140,000) issued in Fy 2006 across all of Eb1/2/3.

    Current System
    EB1 China/India might benefit a bit because they will be the first ones to get the visas from extra EB1 visas but then, if Specter/Frist's bill passes, many of these EB1's will get a chance to file for 485 anyway.

    EB2 China/India might also benefit a little bit provided rest of the world leaves something behind.

    EB3 will not benefit at all as every country is backlogged here.

    Looking at FY 2005 statistics is very misleading. So, the way things are, any bill is better than no bill at all - at least we have a shot at improving the status quo we are in.

    Instead of just comparing current situation with future, especially when the future is so unclear, we should try our level best to achieve the following

    1. Put the clause back
    2. Amendment to file 485 after 140 or labor has been approved for certain time but Visa number is not available. Emphasis should be on the total wait time for GC, so that people in BECs do not get screwed.

    Put all your energy and efforts in achieving these and we will not see retrogression for many years. My goal is not to dissuade people from the comparison - it is a healthy exercise, but now that we know what the pros and cons are, let us work together to solve.

    She responds to email/phone very reasonably (about an hour via email and 99% of the time answers phone). She worked over weekend to file I485.

    She went out of her way to even pay USCIS filing fees from her pocket as there was a delay in processing compnay check. How many of your Lawyers will do that?

    I dont think it is 9,800 each. I think it is 9,800 combined - 7% of 140K. To that extent the 21500 number in my earlier post stands revised down to 17,700.

    It shouldnt cross 7% of 140k which is equal to 9,800 for each category. Not combined.

    Good that some parts of main stream media are tracking issues on EB green cards.

    I don't want to raise/discourage everyone's hopes, but the post is relying on a leader, who lost count to this houses & has the track record of flip-flopping a lot about number of issues & who is hated among veterans even though he himself is a veteran.

    However this gives a great opportunity to IVians, with respect to making EB issue visible to MSM (MainStream Media); Pretty soon there will be a debate between Sen Obama & Sen McCain; Similar to party debates, I guess there will be youtube videos, with polling involved. If we work towards pushing the issue towards debate (by creating & voting on these videos), then candidates & parties may start taking serious look at it and we may see light at the end of the tunnel (hopefully not an incoming train).
